Massachusetts’ highest court has agreed to hear a case filed by a Westport attorney who argues that the state’s bail system is unfair for minors who are wards of the state.
An SCJ appeal is heard in less than 10 percent of all appeals filed in the state, but the case raises questions of whether some youthful offenders in Massachusetts are being denied equal protection under the Massachusetts Constitution and the U.S. Constitution. Feliz-Kidd and appellate attorney Melissa Allen Celli have filed a brief making that argument, and added that several other agencies will be filing their own briefs support of their position.
